USC Employee Reaches Settlement in Disability Discrimination Case

Employee awarded lost and unpaid wages, emotional distress damages, and other damages after alleging USC failed to accommodate his disability

The University of Southern California (USC) settled a disability discrimination lawsuit brought by employee Alberto Lozano, who alleged that the university repeatedly failed to accommodate his documented medical condition and ultimately ended his employment.

Lozano was represented by Neighborhood Legal Services of Los Angeles County (NLSLA) and Orihuela Law Firm, P.C. Under the settlement, Lozano will receive compensation for lost and unpaid wages, emotional distress, and other damages.

“Mr. Lozano asked for reasonable accommodations so he could continue doing his job while managing his medical condition,” said Debra Sudo-Marra of NLSLA. “Instead of providing the requested accommodations, USC repeatedly placed him on unpaid leave. Working on this case reminded us of the importance of protecting workers with disabilities.”

Lozano began working at USC in 2020. Beginning in January 2023, he made requests for accommodations, including a walking boot, temporary lifting restrictions, and later a scheduling adjustment so he could attend regular dialysis treatment. He alleges that USC repeatedly placed him on unpaid leave rather than providing reasonable accommodations, culminating in an October 2023 leave that effectively ended his employment. He also alleged that USC declined to consider him for other positions for which he was qualified.

“All I wanted was to keep doing my job and to be treated fairly,” said Lozano. “This settlement means a lot to me and my family, and I’m grateful to NLSLA and Orihuela Law Firm for standing with me.”

Lozano filed suit against USC in March 2025, alleging violations of California’s Fair Employment and Housing Act and California Family Rights Act, including disability discrimination, failure to provide reasonable accommodation, failure to engage in the interactive process, retaliation, and wrongful termination in violation of public policy.

“I was proud to partner with NLSLA to help Mr. Lozano seek accountability and a meaningful resolution,” said Nicolas Orihuela. “NLSLA brings a deep commitment to its clients and a strong understanding of the communities it serves.”

The settlement resolves Lozano’s claims against USC.

In a related subsequent ruling, the Los Angeles County Superior Court ordered USC to pay attorneys’ fees and costs.
